We’ll start by understanding your financial position and start painting a picture of what a fair settlement could look like. We can help with: 

• Interim finances on separation
• Advice on financial settlements and available options
• Asset division, spousal maintenance, child maintenance and pensions

Finding a resolution

We’ll agree on the right approach to reach an agreement that’s fair, practical and meets your long-term needs, avoiding court wherever possible. This can cover:

• Family mediation
• Negotiation via solicitors 
• Other forms of dispute resolution including arbitration

Formalising your settlement

With an agreement reached, we’ll make sure it’s formally documented in a legally binding consent order or Separation Agreement. 

Court proceedings and enforcement

If an agreement isn’t possible, we’ll help to guide you through court proceedings. We’re experienced at navigating complex litigation cases with conviction. 

Court proceedings typically follow a three stage process. We’ll be at your side throughout: 

• FDA (First Directions Appointment)

  The initial court hearing. The judge considers what information and evidence is needed, identifies the issues in dispute and gives directions for the next stage. 

• FDR (Financial Dispute Resolution hearing)

  A settlement-focused hearing. The judge gives an indication of the likely outcome if the case went to a final hearing. This helps both parties to negotiate. 

• Final hearing

  If an agreement still isn’t reached, the case proceeds to a final hearing. A judge hears the evidence and arguments and makes a binding decision about the financial arrangements.
