Common reasons to enter a pre- or postnuptial agreement

There are many reasons our clients choose to put a nuptial agreement in place. Common considerations include:

  • Protecting existing or inherited wealth – particularly where one or both parties have significant independent assets or expect to inherit in the future.
  • Protecting pre-marital assets – setting out how assets owned before the marriage should be treated if the relationship ends.
  • Providing clarity around financial support – agreeing expectations around financial provision during and after the marriage, helping to reduce uncertainty and conflict.
  • Addressing international circumstances – where you have different nationalities, live or work in different countries, hold overseas assets or may move abroad in the future.

Giving your agreement the best chance 

There are important factors that can affect the weight a court gives to a nuptial agreement. We’ll make sure you understand these and the agreement is prepared with them in mind.

This includes:

  • Full and frank financial disclosure, so both parties understand the financial circumstances before entering into the agreement.
  • Independent legal advice for each party.
  • No undue pressure or coercion, with both parties entering into the agreement freely and with sufficient time to consider it.
  • Timing, with the agreement ideally finalised well before the marriage rather than immediately beforehand. While 28 days is often cited as a useful minimum.
